Home appreciation rates
in many Denver
area communities have been skyrocketing the past seven + years as
severe inventory shortages were being driven by extremely high buyer
demand due to historically low mortgage interest rates. Combined, they
pushed housing prices upwards in unimaginable ways! At one point during
the frenzy between 2020-2022 ("the Covid years") it was common for
listings to sell $10,000 to $400,000 over the list price (...no that's
not a typo) and buyers had to be extremely aggressive with their
contract terms with offering things such as "appraisal gaps", limited
inspections or even waiving them (really bad idea), appraisal waivers,
non-refundable earnest money, ultra-fast closings between 14-21 days and
offering sellers the flexibility to remain in the home post-closing
(rent-free) up to 60-days. It was truly unprecedented. Let's have

Contrary to what you
are hearing in the news or on social media, there
has never, ever been a "standard commission". Listing
commissions remain negotiable today, just as they've for many decades.
Any articles or click-bait links suggesting sellers and buyers are going
to save thousands of dollars on the sale and purchase of a property are
misleading and
require additional context so you can educate understand on what's actually
happening in the
Sitzer-Burnett suit. In a nutshell, starting July 2024, every
MLS in the United States will be prohibited from advertising offers of
buyer broker compensation. Also known as a Buyer Broker "co-op" or
"co-broke" represented the amount a buyer's agent would be paid by the
listing agent, seller or home builder if they successfully represented a
buyer who closed on the property. Additionally, any real estate agent
working with a buyer will be required to enter into a written agreement
with the buyer. In other words, before an agent can show any property,
they MUST have a written contract with you that informs the buyer
they will be responsible for compensating their agent's brokerage firm,
UNLESS the agent can successfully negotiate the fee be
paid by the listing agent, seller or home builder
as part of the
purchase contract. While I understand and appreciate the need for full
transparency, the proposed changes will most certainly have unintended
consequences for both buyers and sellers. In any case, I'm here to
advise and counsel you through the upcoming changes so we can
successfully pivot and continue putting you in the

Are Commissions Negotiable? Of course they are just as they always have been. There's a lot of talk
about listing commissions and lawsuits filed. In a nutshell, sometime in
the summer of 2024, agents will no longer be able to advertise the
compensation being offered to buyer brokers in the MLS. In recent years,
this was something the industry felt would provide transparency to
buyers and seller. However, the DOJ feels that this is actually making
agents "steer" buyers towards properties that paid more. I personally
don't agree because when REALTORS (like me) take an oath to put the
consumer first, that means we're obligated to show every available
property to a buyer - regardless of the compensation paid to the
brokerage firm. But perhaps there were agents who didn't run their
business in a moral or ethical way and this necessitated the change.
Additionally and more importantly, the DOJ wants to ensure buyers and
sellers completely understand how agents are compensated for their
professional services. Sellers must understand that as part of the
overall listing commission negotiated with the listing agent was a %
that was split between agents in order to secure a successful sale.
Sellers were never obligated to compensate the buyer's agent who
successfully brought a buyer to the closing table. In most cases, once a
seller understood that the listing agent was splitting the fee with
another broker, it made it easier to digest because 99% of the time,
they thought the listing agent was keeping all of it! Moving forward,
listing brokers will need to do a better job taking time to explain the
pros and cons of offering a shared broker "co-op" or declining
altogether and seeing how the market reacts. At the end of the day,
agents will need to be more transparent of the process ("explaining how
the sausage is made"). Some will do it better than others and some will
be too intimidated to have the conversation that they'll just leave the
business and find something else to do. This will actually help flush
out many of the bad agents who rushed to get their license like roofers
after a hail storm. The impact in Colorado is expected to be minimal
because our state-approved contracts via the Colorado Real Estate
Commission are so well written, that we have been transparent and
compliant for quite some time. My wife thinks I'm crazy, but I really,
really enjoy the process of walking through the Exclusive Right to Sell
Listing Contract, Exclusive Right to Buy Contract and the various
Disclosures. I love teaching others and walking clients through the
contract gives me a way to talk about the benefits and risks involved in
a real estate contract and stressing the seriousness of this legal
binding venture they are about to embark on. My commitment to
maintaining open, honest and direct communications has served me
throughout the past two decades in this business.
